A DMCA Counter Notice is a notice filed in response to a DMCA Takedown Notice. The Counter Notice is a formal way to say you do not agree with the allegation of copyright infringement, and that you demand the allegedly infringing content be restored.
A DMCA Counter Notice must include the following:
- The identification of the allegedly infringing content that was the subject of the Takedown Notice
- Where the allegedly infringing content was located on the site before being removed
- The name, address and phone number of the person filing the Counter Notice
- A statement that the filer has a good faith belief that the allegedly infringing material was removed because of a mistake or misidentification
- A statement consenting to be sued in Federal District Court
- The physical or electronic signature of the filer
